Just got a text that my reservation has been moved from 2022 to 2023 and I would be charged the new pricing (+$8,450). They will give me a credit of $8500 to offset the price increase but that still leaves me $509 above the new $80,000 threshold for the 2023 tax credit whereas I was eligible for the credit in 2022. I tried to change my order and just drop the spray-in bedliner ($595) which would put me under the $80,000 tax cap with the credit. Easy fix right? Not at all. Ford tells me that even though my truck won't be built until 2023 if I change the order they will not honor my original price and will not offer the credit. This is ridiculous since dropping the spray-in bedliner is such an easy thing to do and from what I heard, is done offsite.

Does anyone have any ideas to solve this issue or am I just McScrewed?

If you take delivery this year, your tax rebate is fine. If you gave your dealer a deposit and have a signed retail order from them for this year, you will also fall into the category where the old tax rules apply.

I will not receive it in 2022 and that is my issue. I did give the dealer a $1600 deposit but in California all deposits are refundable so not sure this would qualify, especially if I take possession in 2023.
Either I need to ask the dealer to modify the MSRP by $509 or somehow get ford to drop the spray in bedliner without nullifying the credit they give to honor the 2022 pricing.

What Is a Written Binding Contract?
In general, a written contract is binding if it is enforceable under State law and does not limit damages to a specified amount (for example, by use of a liquidated damages provision or the forfeiture of a deposit). While the enforceability of a contract under State law is a facts-and-circumstances determination to be made under relevant State law, if a customer has made a significant non-refundable deposit or down payment, it is an indication of a binding contract. For tax purposes in general, a contract provision that limits damages to an amount equal to at least 5 percent of the total contract price is not treated as limiting damages to a specified amount. For example, if a customer has made a non-refundable deposit or down payment of 5 percent of the total contract price, it is an indication of a binding contract. A contract is binding even if subject to a condition, as long as the condition is not within the control of either party. A contract will continue to be binding if the parties make insubstantial changes in its terms and conditions.

You might try having your dealer 'discount' one of the lines on the MSRP 'options' and add it back as a dealer installed 'accessory package' or some other naming so that it is not a MSRP included price.

Reportedly, if you have a binding order in by the end of the year you will qualify for the previous $7500 tax rebate. EV Buyers Guide on YouTube (Alex ***** from Alex on Autos) has a great video that explains all of this.

How do you know your MY 2023 won’t be delivered in CY 2022?

When did you place your order? You may want to try to handle this through the dealer. Most CSRs will tell you that the only way to change an order is through the dealer. Franchise sales agreements and all that stuff, ya know.

I know... I'm so pissed about the price changes. I'm probably going to cancel my registration.

The price protection of $8500 while it will come off the price you pay, the MSRP listed on the order will be the higher amount.

I thought the binding contract had to be completed before the Inflation reduction act was signed. That’s why Rivian had their customer scrambling to get completed in 2 days.

Correct.
If you entered into a written binding contract to purchase a new qualifying electric vehicle before August 16, 2022, but do not take possession of the vehicle until on or after August 16, 2022 (for example, because the vehicle has not been delivered), you may claim the EV credit based on the rules that were in effect before August 16, 2022. The final assembly requirement does not apply before August 16, 2022.

I guess i was thinking of that. So if have this and it comes in after 12/31 you would be covered under the old rule.
